Memorandum of Agreement:
When Sawtoothtrade makes a public offer via this website to program a Sierra Chart spreadsheet study or Simple Alert for a fee, the intention is to provide a service for Sierra Chart users that they are unable to do themselves, or are able and choose not to, where full payment of the total charge is due at completion, unless at the sole discretion of Sawtoothtrade the project has the  considered potential to not be efficacious, then full payment of the total charge is due  in advance  and such payment initiates the project and confirms acceptance of the terms herein; and it is agreed by both Sawtoothtrade and the client that the efficaciousness of the completed project is based on a combination of the programming ability of Sawtoothtrade, the methodological viability of the client’s proposal, and the functionality of Sierra Chart; and it is further agreed that if the completed project is not efficacious due to a programming inability of Sawtoothtrade, a full refund is offered,  but if the completed project is not efficacious because the client’s methodology is not viable or because of a functional limitation of Sierra Chart, no refund is offered at all.

Confidentiality Statement:
If you employ the Sierra Chart spreadsheet or alert programming services of Sawtoothtrade, or if you only provide the details of your methodology to obtain a price quote, you can do so with the confidence that your proprietary system, indicator, or concept as a whole will remain confidential, that it will not be shared with other clients, that it will not be sold for profit, that it will not be divulged to the public domain, and furthermore you acknowledge that it is not a breach of confidentiality if some formulaic commonalities are used in the creation of proprietary algorithms for other clients, nor if the creation of proprietary algorithms for other clients is based on a similar or identical concept arrived at independently of Sawtoothtrade, and you accept that for any such breach of confidentiality mentioned herein the maximum recompense is limited to the total fee paid.

If you use a Sierra Chart autotrading spreadsheet programmed by Sawtoothtrade to initiate automatic trades in an electronically traded market, you do so with the understanding that any trade initiated by it may or may not be profitable, that trading in the market involves risk, that trading with an automatic system has additional risks, and you further acknowledge that, even though great effort has been undertaken to formulate accurate calculations, Sawtoothtrade makes no guarantees that the formulas, expressions, or methodology contained therein will produce profitable trades, and that Sawtoothtrade has no control over how and where this spreadsheet will be used or modified, so you the user assume all responsibility for the profit or loss resulting from these formulations and bear all liability for the utilization thereof.
